Terms of Service

1. Acceptance of Terms

By accessing and using Butix (hereinafter referred to as “the Platform”), you accept these Terms of Service in their entirety. If you do not agree with any of these terms, you must refrain from using the Platform.

2. Description of Service

Butix is an e-commerce and content management platform focused on Colombian women’s fashion. The platform includes:

• Product catalog with checkout and payment processing
• AI-powered virtual try-on tool
• AI virtual fashion advisor (chat)
• Social media content management tool (Social Hub) with integrations to Facebook, Instagram, and TikTok

3. Account Registration

To access certain features, you must create an account by providing accurate and current information. You are responsible for maintaining the confidentiality of your credentials and for all activities performed from your account.

4. Acceptable Use

You agree NOT to use the Platform to:

• Upload illegal, defamatory, offensive content, or content that infringes third-party rights
• Attempt unauthorized access to other users’ systems or data
• Engage in fraudulent activities, including identity impersonation
• Automatically extract, copy, or distribute Platform content
• Use the social media integrations to send spam or automated content without user consent

5. Purchases and Payments

Prices are expressed in Colombian pesos (COP) and include applicable taxes where relevant. Available payment methods are cash on delivery and digital payments processed by third-party providers (Wompi). We reserve the right to reject or cancel orders in cases of pricing errors or availability issues.

6. Shipping and Delivery

Orders are shipped to the address provided by the customer at checkout. Delivery times are estimates and may vary by location. Shipping costs are displayed transparently before confirming the purchase.

7. Third-Party Social Media Integrations

The Social Hub content management tool allows connecting third-party accounts from Facebook, Instagram, and TikTok via OAuth. By connecting a social account, you expressly agree to the following:

• TikTok integration: We use the TikTok Content Posting API (scopes user.info.basic, video.upload, video.publish) solely to publish videos that you explicitly approve within Butix to your own TikTok account.
• Meta integration (Facebook & Instagram): We use the Meta Graph API to publish content to your Facebook Page and Instagram Business account.
• You authorize Butix to publish only content that you explicitly approve
• Butix does NOT sell, rent, or share your social media data with third parties
• Butix does NOT access private messages, comments, or follower data
• You can revoke any connection at any time from your administration panel, which deletes all stored access tokens
• We comply with the platform policies of Facebook, Instagram, and TikTok regarding acceptable use of their APIs

8. Artificial Intelligence Features

The Platform uses third-party AI services for features such as virtual try-on, fashion advisor, and content generation. Images and text that you provide may be temporarily processed by these services. We do not store user images beyond the time necessary to deliver the result. All AI-generated content is clearly labeled and is under your editorial control before publication.

9. Intellectual Property

The design, logos, texts, product images, and source code of Butix are the property of Butix Boutiqueand are protected by intellectual property laws of Colombia and international treaties. Unauthorized use is prohibited.

10. Limitation of Liability

Butix is provided “as is” and we do not guarantee that the service will be uninterrupted or error-free. In no event shall we be liable for indirect damages arising from the use or inability to use the Platform. Our total liability shall be limited to the amount paid by the user for the specific service during the twelve months prior to the claim.

11. Indemnification

You agree to defend, indemnify, and hold Butix Boutique harmless from any claim, demand, or damage, including reasonable attorney fees, arising from your misuse of the Platform or violation of these Terms.

12. Modifications

We may update these terms periodically. Significant changes will be notified to registered users. Continued use of the Platform after such changes implies acceptance of the new terms.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of the Republic of Colombia. Any controversy arising from the interpretation or execution of these Terms will be resolved by direct negotiation in good faith. If no agreement is reached, the competent courts of the domicile of Butix Boutique will have exclusive jurisdiction.
